TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using the RecordHouse mobile application ("App," "Service," "RecordHouse," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

RecordHouse is operated by Simpson Brothers Collective LLC, doing business as Record House ("Company," "we," "us," or "our").

2. Description of Service

RecordHouse provides civic engagement tools that help users track their elected representatives, legislation, voting records, and elections at the federal and state levels. The Service requires users to create an account and provide their residential address to determine their Congressional and State Legislative districts, enabling personalized content delivery.

3. Eligibility

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

To use RecordHouse, you must create an account using one of the following methods:

Email Registration:

  • A valid email address

  • A unique username (minimum 3 characters)

  • A secure password

Third-Party Sign-In:

  • Apple Sign-In (iOS devices only)

  • Google Sign-In

After creating your account, you will complete an onboarding process that includes providing your residential address, which is used solely to determine your Congressional and State Legislative districts and identify your elected representatives.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. User Content and Conduct

When using RecordHouse, you agree to:

  • Provide accurate and truthful information

  • Use the Service in compliance with all applicable laws and regulations

  • Not use the Service for any unlawful, harmful, or fraudulent purposes

  • Not attempt to interfere with, compromise, or disrupt the Service or its servers

  • Not use automated systems (bots, scrapers, etc.) to access the Service without our express written permission

6. User Data and Privacy

RecordHouse collects and processes user data as described in our Privacy Policy, available at https://www.recordhouse.io/privacy-policy.

By using the Service, you acknowledge and agree:

  • We collect your residential address during onboarding solely to determine your Congressional and State Legislative districts

  • We do not store your street address, city, or zip code; we store only your state and voting district information (Congressional district, State Senate district, and State House district)

  • We store your email address for account authentication and Service-related communications (account verification, password reset)

  • We store your in-app preferences and activity, including policy interests, representatives and bills you follow, notification settings, and any alignment quiz responses you provide, to personalize your experience

  • We collect anonymous device fingerprints (device platform, operating system version, and screen dimensions) to prevent trial abuse and ensure fair access to our 7-day free trial; these device fingerprints are not linked to your user account

  • We use Firebase Authentication and Firestore to securely store user accounts and preferences

  • We use RevenueCat to manage subscriptions and process payments through Apple and Google

All data collection and processing complies with applicable privacy laws, including COPPA (Children's Online Privacy Protection Act) for users aged 13-17.

7. Intellectual Property

All content, features, and functionality of RecordHouse, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, and software, are the exclusive property of Simpson Brothers Collective LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

You may not:

  • Copy, modify, distribute, sell, or lease any part of the Service

  • Reverse engineer, decompile, or attempt to extract the source code of the Service

  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices

8. Subscriptions, Free Trials, Billing & Payments

The Service requires a subscription to access after the free trial period.

SUBSCRIPTION OPTIONS:

  • Monthly Subscription - Automatically renews every month

  • Yearly Subscription - Automatically renews every year

  • Pricing is displayed in-app and varies by region

Free Trial

New users receive a 7-day free trial with full access to the Service.

  • You have complete access to all features during the 7-day free trial period.

  • After the 7-day trial ends, you must purchase a subscription to continue using the Service.

  • If you do not purchase a subscription, you will be unable to access the app after the trial expires.

  • You may purchase a subscription at any time during or after the free trial.

  • Each user is entitled to one free trial per device.

Billing & Auto-Renewal

  • Payments are handled solely through Apple or Google.

  • Subscriptions renew automatically unless canceled at least 24 hours before the renewal date.

  • Your account may be charged for renewal within 24 hours of the end of the current billing period.

  • You may manage or cancel your subscription at any time through your device's subscription settings.

  • If you cancel your subscription, you will retain access until the end of your current billing period.

Refunds

  • Refunds for subscription charges must be requested directly from Apple or Google.

  • Record House does not issue refunds and does not process or store payment card information.

9. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.

You may terminate your account at any time by contacting us at support@recordhouse.io or by deleting your account within the app. Upon termination, your right to use the Service will immediately cease.

Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, timely, secure, or error-free

  • The results obtained from using the Service will be accurate or reliable

  • Any errors in the Service will be corrected

RecordHouse aggregates publicly available legislative and representative information from government sources. We make reasonable efforts to ensure accuracy but do not guarantee the completeness, accuracy, or timeliness of this information. Legislative data may be delayed, incomplete, or contain errors from source systems.

AI-GENERATED CONTENT

RecordHouse uses artificial intelligence to provide certain features, including bill summaries, political classification of legislation, and alignment/compatibility scores. AI-generated content is provided for informational purposes only and may contain errors, inaccuracies, omissions, or biases. We strongly encourage users to review official bill text available in the Documents tab and consult authoritative government sources for accurate information. Alignment and compatibility scores are algorithmic estimates based on AI analysis and user-provided quiz responses, and may not accurately reflect the true political positions of representatives or the actual impact of legislation. Users should not rely solely on AI-generated content when making decisions.

IN NO EVENT SHALL SIMPSON BROTHERS COLLECTIVE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless Simpson Brothers Collective LLC, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to:

  • Your use or misuse of the Service

  • Your violation of these Terms

  • Your violation of any rights of another party

  • Your violation of any applicable laws or regulations

12. Third-Party Services and Content

RecordHouse integrates with third-party services, including:

  • Firebase (Google LLC) for authentication and database services

  • RevenueCat for subscription management

  • Google Places API for address autocomplete

  • Google Civic Information API for district lookup

  • Algolia for bill search functionality

  • Artificial intelligence services for AI-generated bill summaries and analysis

  • SendGrid for transactional email delivery (account verification, password reset)

  • Expo for app delivery and updates

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

Legislative data, representative information, and voting records are sourced from publicly available government databases and APIs, including Congress.gov, state legislature official websites, and other public data sources. Data may be delayed or incomplete depending on source availability. We are not affiliated with any government entity and do not guarantee the accuracy, completeness, or timeliness of this information.

13. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, and without liability to you.

The Service may receive over-the-air updates that do not require downloading a new version from the App Store or Google Play Store. These updates may include bug fixes, performance improvements, and minor feature enhancements. By using the Service, you consent to receiving such updates automatically.

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

The "Last Updated" date at the top of these Terms indicates when they were last revised.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Colorado, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Colorado, and judgment on the award may be entered in any court having jurisdiction.

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

15. Geographic Restrictions

RecordHouse is intended for use by residents of the United States. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

16. Entire Agreement and Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Simpson Brothers Collective LLC regarding the use of the Service and supersede all prior agreements and understandings.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

17. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or provisions.

18. Apple App Store Terms

If you access the Service through the Apple App Store, the following additional terms apply:

  • These Terms are between you and Record House only, not Apple, and Record House, not Apple, is solely responsible for the Service and its content.

  • The license granted to you is limited to a non-transferable license to use the Service on any Apple-branded device that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

  • Apple has no obligation to furnish any maintenance and support services with respect to the Service.

  • In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service.

  • Record House, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your use of the Service, including: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

  • In the event of any third-party claim that the Service or your use of the Service infringes that third party's intellectual property rights, Record House, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

  • You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

  • You must comply with applicable third-party terms of agreement when using the Service (e.g., you must not be in violation of your wireless data service agreement when using the Service).

19. Google Play Store Terms

If you access the Service through the Google Play Store, the following additional terms apply:

  • These Terms are between you and Record House only, not Google, and Record House, not Google, is solely responsible for the Service and its content.

  • Google has no obligation to provide maintenance, support, or updates for the Service.

  • Google is not responsible for addressing any claims by you or third parties relating to the Service or your possession and/or use of the Service, including but not limited to: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

  • In the event of any third-party claim that the Service or your use of the Service infringes a third party's intellectual property rights, Record House, not Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

  • Google and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Google will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
